On the implementation plan of building an intermediary supermarket for investment approval in the whole province

According to the Notice of the General Office of the State Council on Printing and Distributing the Work Plan of Streamlining Examination and Approval Items, Standardizing Intermediary Services and Implementing Online Parallel Approval System for Enterprise Investment Projects (Guo Ban Fa[2014] No.59), Notice of General Office of the State Council on Cleaning up and Standardizing the Intermediary Service of Administrative Examination and Approval of the State Council Department (Guo Ban Fa [2015] No.31) and May 18, 2015.In order to further optimize the investment environment of the whole province, strengthen the management of intermediary institutions and standardize the intermediary service behavior, the Japanese Provincial People’s Government has formulated the following regulations.This scheme.

First, the target requirements

Adhere to administration according to law, market-oriented, strengthen supervision, standardize and be efficient, and rely on government affairs (investment project approval) service centers at all levels (hereinafter referred to as service centers at all levels) to build a network.Network-based, supplemented by entities, three-level intermediary supermarkets in provinces, cities and counties. Before December 31, 2015, intermediary supermarkets at the provincial level and in 16 cities and new industrial zones in central Yunnan will be built; June 2016Before May 30th, 129 intermediary supermarkets in counties, cities and districts will be built.

Second, the functional orientation

(1) Standardize management functions. (2) Trading service function. After the information management system releases the information on the purchase of intermediary services by financial funds at all levels, the institutions stationed in the intermediary supermarket shall register online and bid openly.And open selection, and then the intermediary supermarket management organization publicizes the winning result, so as to realize the "one-stop" transaction service of selecting intermediaries.

(3) The function of supervision and evaluation. Through the entity platform and information management system of intermediary supermarket, online and offline public selection and purchase of intermediary services are realized, and the whole process is tracked, supervised and recorded.Management information such as the situation and service quality, and objectively make a credit rating evaluation.

Third, the construction principle

(1) Full opening. In accordance with the principle of "openness, fairness, justice and non-prohibition", we will fully open the intermediary service market for investment approval in our province and break the ridge of regions and industries.Break and protect, stimulate market vitality, cultivate and develop an open and competitive intermediary service market.

(2) Equal competition. Administrative organs and institutions at all levels shall adopt the mode of equal competition and openly select and use financial funds to purchase, except for public bidding as stipulated by laws and regulations.Investment approval intermediary service. Enterprises may, according to the voluntary principle or business needs, entrust intermediary supermarkets at all levels to provide equal competition and openly select and purchase intermediary services.

(3) Strengthen supervision. In accordance with the principle of "classification and dynamic management", establish a list of investment approval intermediaries and service items, implement the responsibility of the regulatory body, and improve the letter.With the system and evaluation mechanism, we will implement the system of lenient entry and strict management and disciplinary elimination.

(4) Standardized and efficient. Improve the service norms and standards of intermediary institutions, optimize service processes, standardize practice behaviors, and improve service quality. Unified establishment of the basic files of the province’s intermediaries., business data and project information base to realize data integration, resource sharing and efficient operation.

Fourth, the scope of residence

(a) to provide administrative organs and institutions at all levels with all kinds of technical review, demonstration, evaluation, evaluation, inspection, testing, verification and appraisal as the acceptance conditions for investment approval.Enterprises, institutions, social organizations and other institutions (hereinafter referred to as intermediaries) that provide paid services (hereinafter referred to as intermediary services) such as certification, consultation and testing shall, through the Internet.On the declaration, qualification confirmation, registration and other procedures, settled in the province’s information management system. Specifically including:

1. Consulting and evaluation category. Project proposal, project feasibility study report, project application report, planning and site selection, environmental impact assessment, energy conservation assessment, soil and water conservation, water resources demonstration., flood impact assessment, forest land requisition (occupation) feasibility study and other documents, cost consultation, safety assessment, occupational health assessment, land assessment, meteorological assessment, earthquake safety assessment.Price, cultural relics impact assessment, real estate assessment, geological disaster risk assessment, etc.

2. Exploration and design. Geological exploration, engineering exploration, architectural engineering design, design of protective facilities for occupational hazards, construction drawing review, etc.

3. Survey and survey category. Engineering survey, real estate survey, land surveying and mapping, cadastral survey, etc.

4. Test service class. Fire fighting equipment and facilities, engineering quality, safety production, occupational hazard factors and other testing services.

(two) the mandatory and designated intermediary institutions as the acceptance conditions of investment approval stipulated by laws and regulations shall be settled in intermediary supermarkets at all levels after being confirmed by the competent department of industry.

(3) Other intermediaries that are not directly related to the investment approval shall follow the principle of voluntariness and choose whether to settle in intermediary supermarkets at all levels.

V. Division of tasks

(a) the development and deployment of information management system. Follow the principle of "unified development, centralized deployment, unified standards, resource sharing, unified platform and three-level use" to develop and construct information.Management system, including project declaration, bidding procedures, development and deployment of software systems, procurement and installation of hardware and equipment. (2) Building intermediary supermarket platforms at all levels. Relying on service centers at all levels, we will build intermediary supermarkets such as information display, on-site consultation, open selection, signing witness, supervision and management.Service platform, and create conditions for intermediary entities to settle in. Governments at all levels and the Administrative Committee of Central Yunnan Industrial New District take the lead. VI. Relevant requirements

(1) Strengthen organizational leadership. (4) Strengthen supervision and inspection. Interim Measures for the Administration of Investment Approval Intermediary Supermarket in Yunnan Province

Chapter I General Principles

the first In order to further strengthen and standardize the management of intermediary supermarkets (hereinafter referred to as intermediary supermarkets) in our province’s investment approval (including approval or filing, the same below), and build a fair, open, competitive, honest and trustworthy intermediary service market with standardized practice, these measures are formulated in combination with the actual situation in our province.

the second Intermediary institutions as mentioned in these Measures refer to institutions and social organizations that provide clients with intermediary services such as consultation, evaluation, exploration and design, survey and testing involving investment approval through professional knowledge and technical services according to law. Intermediary supermarket refers to a comprehensive management platform built by governments at all levels in a way of combining network and entity, which provides services such as qualification registration, information publicity, personnel management, reputation promotion, service selection, contract management, credit evaluation, etc.

Article Intermediary supermarkets follow the principle of "openness, fairness and justice" and are open to intermediaries with legal intermediary service qualifications in the country according to laws and regulations. Intermediaries that undertake the use of financial funds by administrative organs and institutions at all levels to purchase intermediary services must settle in intermediary supermarkets; Mandatory and designated intermediaries as the acceptance conditions of investment approval stipulated by laws and regulations are voluntarily settled in intermediary supermarkets after being recommended by the competent department of industry; Other intermediaries follow the principle of voluntariness and choose whether to enter the intermediary supermarket.

Article 4 Intermediary supermarket is a unified place where governments at all levels openly select intermediaries to buy services. Except as required by laws and regulations, when administrative organs and institutions at all levels use financial funds to purchase services from intermediaries, they must openly compete to select intermediaries in intermediary supermarkets. According to the principle of voluntariness, enterprises can entrust intermediary supermarkets at all levels to provide public selection of intermediary services according to their business needs.

Article 5 Yunnan Online Intermediary Information Management System (hereinafter referred to as the information management system) is a unified information management platform for intermediary supermarkets in Yunnan Province, following the principle of "unified standards, unified norms, unified platform and resource sharing", providing all kinds of online services for intermediaries in the province, and providing online public selection of intermediary services for intermediary supermarkets at all levels.

Article 6 All localities and departments follow the principle of "separation of management and operation" and comprehensively manage intermediary supermarkets according to their statutory duties. The specific duties are as follows:

(a) the provincial government service management agency is responsible for coordinating the construction and management of intermediary supermarkets in the province, organizing intermediary agencies to settle in for filing and registration, issuing relevant normative documents of intermediary supermarkets, standardizing various business processes of intermediary supermarkets, and being responsible for the construction, operation and maintenance management of information management systems;

(II) Governments at all levels and the Administrative Committee of Central Yunnan Industrial New Area shall co-ordinate the construction of intermediary supermarkets at the corresponding level, and the administrative service administration at the same level shall be responsible for operation, maintenance and management, and organize administrative organs and institutions to openly select intermediary institutions according to the norms;

(three) the competent departments of industry at all levels are responsible for the qualification verification and confirmation of intermediary institutions, the examination and approval of service matters and business processes, and perform the duties of industry supervision according to laws, regulations and rules;

(four) supervisory organs at all levels and government supervision departments are responsible for supervising the implementation of various institutional measures of intermediary supermarkets in various localities and departments.

Chapter II Registration of Intermediaries in China

Article 7 Intermediary agencies that participate in the government’s purchase of services and provide the following intermediary services must settle in intermediary supermarkets. The specific scope is:

(1) Consulting and evaluation. Project proposal, project feasibility study report, project application report, planning and site selection, environmental impact assessment, energy-saving assessment, soil and water conservation, water resources demonstration, flood impact assessment, feasibility study for forest land requisition (occupation) and other documents, cost consultation, safety assessment, occupational health assessment, land assessment, meteorological assessment, earthquake safety assessment, cultural relics impact assessment, real estate assessment, geological disaster risk assessment, etc.;

(2) exploration and design. Geological exploration, engineering exploration, architectural engineering design, design of protective facilities for occupational hazards, construction drawing review, etc.;

(3) Survey and investigation. Engineering survey, real estate survey, land mapping, cadastral survey, etc.;

(4) Testing services. Fire fighting equipment and facilities, engineering quality, safety production, occupational hazard factors and other testing services.

Article 8 Provincial government service management organization unified qualification confirmation and registration in the information management system. Intermediaries in intermediary supermarkets can carry out their business activities within the scope of qualification license in the whole province, and there is no need to register separately in each state, city, county and district (Central Yunnan Industrial New District).

Article 9 Intermediaries entering intermediary supermarkets must meet the following conditions:

(1) It has been registered and established according to law, has the qualification of an independent legal person, and has obtained the qualification of legal intermediary service;

(2) Having sound practice rules and other corresponding management systems;

(three) the provisions of laws and regulations can carry out business activities in our province;

(4) It has no bad credit record in the past two years.

Article 10 Intermediary institutions shall apply for settlement through the information management system, and make a commitment to the service items, service quality and charging standards provided by this institution. The following application materials shall be submitted when applying for residence, and the original electronic scanned copy shall be uploaded when applying online:

(a) "Yunnan province" intermediary supermarket registration form "in duplicate and stamped with the official seal;

(2) A copy of the industrial and commercial business license and organization code certificate (if it is a public institution, provide a copy of legal person registration certificate) in duplicate and affix the official seal;

(three) a copy of the legal representative’s ID card and a copy of the business authorized representative’s ID card in duplicate and stamped with the official seal;

(four) the original copy of the qualification certificate in duplicate and stamped with the official seal;

(five) the qualification registration form and license of employees are copied in duplicate and stamped with the official seal;

(six) the internal management system and the certification materials of the honor;

(7) An original credit report issued by the People’s Bank of China or the statutory credit reporting agency where the intermediary agency is located;

(eight) the materials required by laws and regulations for the record of qualification in our province.

Article 11 After the intermediary applicant submits the application, the information management system will transfer it to the relevant industry authorities according to the qualification of the declaration. The competent department of industry shall, after receiving the application for the entry of intermediary agencies, pre-examine the online application materials within 2 working days, and inform the intermediary agencies of the problems existing in the application materials, how to supplement and supplement the materials and other matters through the information management system at one time.

Those who pass the preliminary examination shall be accepted, and the applicant shall be informed by the information management system to bring the application materials and the original certificates to the competent department of industry for on-site qualification verification within 10 working days. After verification, the competent department of industry shall, within three working days, report the confirmation results to the provincial administrative service management institution, and the institution shall register in the information management system and publish the relevant information of the application intermediary. If the applicant fails to arrive at the site to verify the qualification within 10 working days due to special reasons, it shall apply to the competent department of industry for delayed verification, but the extension time shall not exceed 10 working days. If the applicant fails to submit the original qualification for verification on time within the extended time limit, the competent department of industry shall not confirm it.

Article 12 After the registration, the intermediary supermarket management institution shall distribute exclusive web pages and handle electronic digital certificates for the intermediary institutions in the online lobby of the province. Intermediaries can maintain and update relevant information on their own web pages and participate in the trading activities of the information management system.

Article 13 The validity period of the intermediary service in the intermediary supermarket is consistent with the validity period of its qualification certificate. Involving the change of information such as the continuation of residence, business authorization, etc., the intermediary institution shall apply for the change through the information management system with the electronic digital certificate and valid license, and the competent department of industry shall verify that the original relevant materials are correct before making the change.

Chapter III Information Management of Intermediaries

Article 14 Establish a unified and shared database of intermediary supermarkets in the province to manage the information of intermediary agencies, and open a unified online information publicity column in the information management system to publicize the information of intermediary agencies in the database and provide online information services such as classified retrieval and service comparison for the public.

Article 15 The information collected in the database of the intermediary supermarket shall include the business scope of the institution or organization, the name of qualification certificate, grade, validity period, legal representative, authorized business representative and personnel structure, management system, honor, service commitment, charging standard, credit record, etc., and be scientifically classified in strict accordance with the categories, specialties, industries, service scope and grades stipulated by laws and regulations, so as to comprehensively, truly and objectively reflect the situation of the intermediary institutions and ensure that they are kept in the library.

Article 16 Intermediary institutions that have settled in the intermediary supermarket declare their presence online, and the submitted information is automatically collected and entered into the database of the intermediary supermarket. The scanned and uploaded license attachments generate electronic licenses through the Yunnan Electronic License Management System as the electronic license information of the institution.

Article 17 Intermediaries maintain and update the information in the library that can be changed by themselves, such as the personnel structure, management system, honor, service commitment and charging standard, etc. of intermediaries with exclusive web pages.

Article 18 Information related to the credit records of intermediaries is collected from the relevant competent departments through the online lobby data exchange platform and then accessed to the intermediary supermarket database, and the credit status of intermediaries is publicized in the online intermediary information management system of the province.

Chapter IV Methods of Public Selection of Intermediaries

Article 19 Administrative organs and institutions at all levels shall, in accordance with the principle of "one thing, one choice", openly select intermediaries in intermediary supermarkets when purchasing intermediary services as stipulated in Article 7 of these Measures with financial funds. In the information management system, administrative organs and institutions are set up to openly select the bulletin columns of intermediaries, and the information of publicly selecting intermediaries by administrative organs and institutions at all levels is uniformly released to intermediaries who have settled in intermediary supermarkets.

Article 20 The owner unit shall, when issuing the announcement of public selection of intermediaries, determine the way of public selection of intermediaries. The details are as follows:

(1) Random selection: more than 2 intermediaries signed up for the open selection activities (including 2 intermediaries). Under the joint participation and supervision of the owners, intermediaries and supervision departments, a computer random lottery method is adopted, which is operated by the staff of government affairs (investment project approval) service centers at all levels (hereinafter referred to as service centers), and one intermediary is randomly selected from the intermediaries signed up for the information management system as the winner;

(2) Online bidding+random selection. There are more than two intermediaries who have signed up for public selection activities, and between the highest price limit and the lowest price limit set by the owner, the intermediaries bid in the information management system, and the interval between each bidding is 5 minutes. If other bidders fail to bid within 5 minutes before the minimum price limit is exceeded, the current bidder is the successful bidder; If there are more than two intermediaries whose bids have reached the lowest price limit, and the bids of other intermediaries have not reached the lowest price limit within 5 minutes, the bidding will be stopped, and one intermediary will be selected by computer random selection from the intermediaries whose bids have reached the lowest price limit; Using "online bidding+random selection", when the minimum price is not reached, the winner will be automatically determined according to the bidding results; If entering the random drawing link, the service center will inform the participating intermediaries of the time and place of random drawing, and agree on the time and place to draw the successful candidate.

Article 21 Administrative organs and institutions at all levels need to use financial funds to provide services to publicly selected intermediaries due to business needs. They need to apply in the information management system, fill in the Application Form for Purchasing Services of Intermediary Supermarket, affix the official seal of the unit and deliver it to the service center at the same level in duplicate, and register the following information in the information management system:

(a) the name of the owner;

(two) the content of intermediary services, service time limit and service fee (including the maximum price and minimum price); The service fees that are randomly selected shall be reduced by no less than 20% according to the national standard fees; The service fee of "online bidding+random sampling" method shall not be higher than the national standard fee, and the minimum price shall not be higher than 80% of the national standard fee;

(3) Basic information on the subject matter of intermediary services. Involving the project, it shall include the name, address and basic information of the project (including specific parameters such as construction scale, construction area and capital investment); Involving land and real estate assessment, it should include land, real estate area, budget price and other contents;

(4) Qualification requirements of intermediary institutions. Including qualification category, specialty, industry, service scope, grade and so on. The qualification level should be set according to the minimum level required by the statutory service of the intermediary service subject matter, and the qualification above the minimum level should be selected;

(5) The deadline for registration shall be no less than 2 working days after the announcement;

(six) the time and place of public selection of intermediaries. The time for public selection of intermediaries should be on the first working day after the deadline for registration;

(seven) telephone consultation and supervision, contact and contact number;

(eight) public selection of intermediary institutions;

(nine) the intermediary agencies to avoid;

(10) Whether to issue the announcement of winning the bid;

(eleven) the need for detailed provisions on the procurement of intermediary services, should be separately formulated to require the text to be uploaded to the information management system;

(twelve) to submit an application for the purchase of intermediary services online, it shall be uploaded together with the approval of the government for the purchase of intermediary services and the approval of financial arrangements.

Article 22 Service centers at all levels shall, after receiving the application for open selection of intermediary services, confirm the content of procurement services, qualification requirements and the time for open selection of intermediary agencies with the applicant within 2 working days, and issue a procurement announcement in the information management system, which includes all the information of online registration of the applicant.

Article 23 After the announcement information is released, the information management system automatically starts the online registration and the calculation of the registration time limit for the purchase of intermediary services, and automatically sends the announcement information to the mobile phone and exclusive webpage of the qualified intermediary agencies in the "intermediary supermarket" database according to the intermediary qualification requirements set by the applicant, inviting the intermediary agencies to sign up for the open selection activities. Open selection of intermediary activities does not accept on-site registration, and after the deadline, the information management system will no longer accept application for registration.

Article 24 If an intermediary agency intends to participate, it shall submit an application for registration through the information management system with an electronic digital certificate or a dedicated webpage before the deadline for registration, and promise to meet all the requirements of the announcement. If the public selection is made in a random way, the intermediary agency may determine whether to go to the site according to its own reality when registering.

Article 25 Service center staff at all levels and representatives of the owner’s unit shall arrive at the service center 15 minutes before the public selection time, and confirm the applicant on the spot. If the method of random selection is adopted, the participants of the intermediary institution shall hold a copy of the organization code certificate or business license of the intermediary institution and affix the official seal and the original ID card, and arrive at the scene 15 minutes before the public selection for confirmation; If online bidding or "online bidding+random selection" is selected, the intermediary institutions that sign up for the competition need not arrive at the site.

Article 26 Service centers at all levels shall conduct real-time monitoring and recording of live video for public selection to ensure that the public selection process is open, fair and just. After the results of public selection are confirmed by the on-site representatives and entered into the information management system, the service centers at all levels will issue the Confirmation Letter of Public Selection of Intermediaries in Yunnan Province (hereinafter referred to as the Confirmation Letter) in quintuplicate and affix the official seal to the owner unit, which shall affix the official seal on the confirmation letter and deliver it to the selected intermediaries and service centers at all levels within 2 working days.

Chapter V Credit Management and Accountability of Intermediary Services

Article 27 Provincial departments in charge of various industries shall, in combination with the scope of intermediary services, establish a unified and standardized contract text for intermediary services in the province. If an intermediary service is purchased through open selection, a contract must be signed using the standard text of intermediary service. Enterprises can refer to the use of standard texts when purchasing intermediary services independently. The standard contract text of intermediary service shall include the following contents in addition to the contents required by the statutory contract text:

(a) the number of personnel performing the contract and the requirements for professional qualifications;

(2) Service quality requirements;

(three) the way to deal with the objection;

(four) the service time limit requirements and regardless of the service time limit.

Article 28 After receiving the confirmation letter, the selected intermediary agency shall sign an intermediary service contract with the owner unit within 3 working days, and the owner unit shall register it in the information management system.

  I am a "senior" landscape painter who is obsessed with landscape painting creation and has painted landscape paintings for most of my life, and I am quite ignorant of landscapes. After repeated attempts and breakthroughs and peaks, I hope to return to the original point, temporarily calm down my passion for creation, re-understand China’s landscape painting from a theoretical height calmly and objectively, and reflect on my landscape painting spirit. However, I know that to objectively, accurately and comprehensively understand the artistic attributes and goals of my own landscape painting, I have to ask for advice from specialized art theorists. As the saying goes, "a good writer does not learn from others", not only writers, but also painters. When I graduated from my doctor’s degree, I studied with Mr. Jin for five years. I have completed the most important part of the study on the origin of China’s landscape painting, which can be described as a small achievement. Knowing both philosophy and art, it is more appropriate for him to lead the research. So I gave him full trust and he accepted the challenge.

  After several rounds of communication, Dr. Zhao Chao gave nine themes of the dialogue: orthodoxy, self-cultivation, temperament, pen and ink, skill, teaching, tradition, in vitro and innovation, and drew up a general outline of each theme. It is very important to study these nine topics in groups of three, with the front leaning inward and the back leaning outward. After choosing the theme, we began to think about the candidates for the dialogue. Because of my position, I have work contacts with many theorists. Finally, due to karma, I decided to talk to all the theoretical experts, among whom the topic of "orthodoxy" was talked with Mr. Yu Hui, an expert on ancient calligraphy and painting appraisal in China; The topic of "self-cultivation" is a dialogue with Mr. Zhu Liangzhi, a Chinese aesthetic historian; The topic of "temperament" talks with Mr. Shao Dazhan, an art theorist; The topic of "pen and ink" is a dialogue with Mr. Lang Shaojun, an art historian in modern China; The topic of "technical ability" and the sculpture field that emphasizes high-tech tradition are talked with Mr. Wu Weishan; The topic of "teaching" was discussed with the educator Mr. Pan Gongkai.Because Mr. Pan Tianshou established a modern teaching system of Chinese painting, which is well known to Mr. Pan Gongkai; The topic of "tradition" is a dialogue with Mr. Xue Yongnian, an ancient art historian in China; The topic of "in vitro" is in conversation with Mr. Yi Ying, a western art historian; "Innovation" is a dialogue with Mr. Yin Jinan, an art theorist and art critic.

  Scholars not only have extensive knowledge and comprehensive professional knowledge, but also have deep understanding and great achievements in their own fields. Nine dialogues lasted for three years, which not only enabled me to understand my artistic spirit more clearly, but also gained new knowledge in the in-depth and extensive discussion of ancient landscape painting and modern landscape painting, and I gained a lot. The rich content, interesting ideas and high specifications of these dialogues are rare for so many years. I believe these valuable conversations will definitely have a positive impact on landscape painting lovers. Therefore, we will also arrange and publish these nine dialogues in a way that is easy for readers to understand.
